FREIGHT LOSS/DAMAGE LIABILITY & PROCEDURE

Creative Transportation Services Inc. is a Transportation Broker licensed by the Federal Highway Administration, MC385535.

We are extremely prudent in utilizing only the services of partner carriers whose Claims histories are exemplary.

However, in the unlikely event that freight is lost or damaged, CTS will assist our clients in the preparation of the Standard Form for Presentation of Loss and/or Damage Claim, submit the claims to the carrier, and follow the claims process through to completion.

As a licensed broker, we operate under provisions of 49 CFR Part 1045 which states that a broker has no legal liability for freight loss or damage.

However, we only utilize partner carriers who have provided CTS with insurance certificates specifying their compliance with the legally mandated coverage.

Should a client choose to transport merchandise of extraordinary value, we are in a position to offer them additional coverage up to the full replacement value of their cargo.

Should it become necessary to file a claim, please contact us immediately. If the claim is for damage, we will request the approximate replacement or repair cost of that portion of the shipment which has sustained damage to determine if an outside inspection should be re quested.  Please do not move the freight, and, if possible, take photographs to assist us in substantiating the extent of the damage.

We will file the claim on your behalf and will request that you provide the following:

1)  Copy of the Delivery Receipt showing the damage or shortage notations
2)  Copy of the original invoice for the goods in question
3)  An itemized account of loss or damage if this is a partial loss
4)  Any other information that you might have in your possession that will further substantiate the claim.

We will advise you once the carrier has acknowledged receipt of the claim (which regulations stipulate they must do within 30 days from file date). 

We will advise you immediately upon final resolution of the claim or will request whatever further information the carrier may require to assist them in the investigative process.
